Regulation of elections to the board of the CASS

The Government approved (BOPA 24/22) the regulation of elections to the board of the Andorran Social Security (CASS) , in relation to the practical organization and conduct of the elections to be held on On 28 June 2010.
The Regulation repeals Regulation of elections to the Board of Directors of CASS dated 8 March 2006, while the electoral law of the referendum and act as a reference standard in everything that has been specially planned in these regulations and the Law 17/2008, October 3, social security.

Decree approving the Rules of the board of elections to the Andorran Social Security (CASS)
Reason
The first title of Chapter Three of Law 17/2008 of October 3, social security, the governing board of elections.
Rules be developed for the practical organization and conduct of the elections.
Also appropriate to repeal Regulation of elections to the board of the CASS dated 8 March 2006, which developed the law regulating the management and administrative organization of the Andorran Security revoked by law, to adapt the practical organization and conduct of the elections to the board of the Andorran Social Security in the new legal framework.
Consequently, the Government at its meeting of 21 April 2010, approves this Decree to read as follows:
Sole Article
Approves the election board of the Andorran Social Security (CASS), which comes into force the day after being published in the Official Gazette of the Principality of Andorra.
The elections will take place on 28 June 2010.
Additional
Law of the electoral and referendum act as reference standard in all that has not been specifically provided in these regulations and the Law 17/2008, October 3, social security.
Derogatory
Is repealed Regulation of elections to the Board of Directors of CASS dated 8 March 2006.
Article 1 General Provisions
1. Before terminating the mandate of the Board of Directors, and respecting the deadlines set in Articles 71 and following of Law 17/2008 of October 3, social security, the government fixed the date of elections, the board heard.
2. The chairman of the board organizes elections considering the timing of which has been agreed by the Government.
3. All terms mentioned in this Regulation are understood stipulated in calendar days.
4. It is considered official documentation of each polling all of the following documents:
- Or the lists of electors
- Minutes of the ballot signed by members of the Board
- The set of ballots not challenged,
- The folds of spoiled ballots and votes of appeal, and if applicable, the corresponding envelopes.
Article 2 Preparation of electoral lists
1. The CASS manufactures electoral lists for each polling station.
2. Voters are the contributors who meet the requirements of Articles 67 and 68 of the Act and are registered with the CASS day of its publication in the Official Gazette of the Principality of Andorra (BOPA) the date of the election.
3. In the electoral college of business and the people performing an activity on their own are considered employers, individuals or legal entities defined in Article 23 of the Act. If the employer is an individual, entered the list of electors the first person that consists the owner of this company with the CASS. If this person refuses to vote in his favor of another charge of the company will inform the CASS before the start date of the vote for deposit.
4. Electoral lists can be consulted by all contributors to the CASS office from April 28th, five days after publication in the BOPA date of the election.
Article 3 Application for enrollment in electoral list
1. The contributors not registered on electoral lists have a term of eight days of the date of commissioning of the lists available to go to letter to the Board of Directors of CASS and request their enrollment by attaching the relevant documentation.
2. The Board of Directors of the CASS has a period of eight days from receipt of the request for registration of the appellant declared his decision. Decisions must necessarily be rejected motivated.
Article 4 Nominations
1. May be candidates for election to the Board of Directors of the Andorran Social Security people who meet the conditions laid down in Article 69 of Law 17/2008 on social security.
2. The nomination is made by an official document provided by the CASS that consists in the Electoral College, the name of the candidate and his passport number.
3. The Board of Directors of CASS verifies and publishes BOPA that the candidates meet the requirements laid down in Articles 69 and 70 of Law 17/2008, within fifteen days after the last day for nominations.
Article 5 Election campaign
1. For the purpose of facilitating the nomination of the various polling stations access to the electorate, the board will be at your disposal a newsletter, a maximum of half a sheet for candidacy to it may include "professions of faith." The same board will establish the modalities and terms of delivery of documents and shall send the insured the appropriate newsletters.
2. Nominations can use the media during the election campaign, provided that the spaces of expression are given it free of charge and strictly respects the criteria of equality.
3. To ensure equality between the aforementioned candidates, they can not use other means of election campaign that is summarized in the preceding paragraphs.
4. In the announcement of elections, the government set the duration of the election campaign that lasts for ten days
Article 6 Methods of voting
1. The vote is conducted in person or by deposit made at the direction of the CASS.
2. The ceremony will be attended by a deposit of responsible service of CASS, express prior designation made by the Director, notified in writing to the board of the CASS.
Article 7 The vote to deposit
1. The vote to be valid if deposit is given on the official ballots and the opposite direction of the CASS, or representative, between the seventeenth day after the publication of the BOPA nominations and 13 hours before the holding of votes, inclusive.
2. The vote to deposit issued by their own voters to the depositary, without delegation to third parties as possible in the local direction of the effect and to enable CASS during regular office hours to the public Office of the CASS.

4. The board shall forward to the director of the CASS sufficient number of envelopes. These envelopes will be kept by the director of the CASS. Once the election, the remaining envelopes will be returned to the board.
5. The deadline established by vote of deposit, the director will personally get the votes that voters have given to the chairmen of the polling stations, which are introduced in the various polls, after verification of the quality of elector of depositors of accordance with Article 12. Finished, the director, in the presence of the presidents of each table, shall seal each ballot box by lifting the corresponding act to sign with the President of each table. Apart from the incidents that the director of the CASS considers that it must refer the minutes contain not only details of the seal of each ballot box but also will make an explicit reference to the votes that have not been admitted to the polling stations in the effect to be returned to the respective depositors.
6. Before opening the election, the director of the CASS, the presence of the presidents of each table, shall seal the ballot box, again extending the corresponding act.
Article 8 The personal vote
1. The vote takes place in the building of the CASS, or in any other place that the board specifically to enable the effect.
2. The polling stations opened at eight in the morning and closed at nine in the evening, without interruption.
3. The government fixed the election day always on a weekday.
Article 9 electoral officers
1. The board is composed of one or more polling stations at least one member of the board and a staff member of the CASS, during the day, will be replaced by another member of the board and Another staff member of the CASS.
2. The chairman of the board is the member of the board.
3. Each candidate may propose an auditor and one alternate for each polling station.
4. Because if one candidate lost the right to sit for final judgment, death or disability, all set for the day before the election, the votes will be replaced by the next candidate on the lists, without modification of the ballots.
Article 10 ballots
1. All ballot papers and envelopes should be the same shape, size and weight of paper in all the polling stations, according to characteristics established by the Board of Directors of CASS.
2. The color is clearly different for each polling station and ballot papers and envelopes must be the same corresponding color.
Article 11 of the local characteristics where the vote
1. In the place where the voting takes place, are installed one or more cabins insulators, in which there are a sufficient number of ballots for each candidate, and others white.
2. All lists of candidates for election must be in view of the local voters in the voting takes place.
3. Enabled three ballots in each polling station, one for each polling station, all transparent or the same color as the corresponding envelopes and ballots.
Article 12 Voting procedure
1. Before voting, the voter, previously identified by presenting an identity document or passport is not expired on the list or lists of electors concerned, receives the President of the Board / s on / s required / s for a vote.

Article 13 Scrutiny

3. All valid votes are the result of the votes cast, deduction made of white and null votes.

5. If an envelope contains more than one identical ballot is counted as one valid vote. If the ballots are not identical, the vote is null.
6. The white votes are recorded regardless of the valid votes and spoiled ballots.
7. If challenged by a voting member of the board or a controller, attached to the ballot for official documentation.
8. It is mandatory to keep the ballot papers not challenged the CASS until fifteen days have elapsed from the day after the election.
Article 14 Results
1. The results of the vote are recorded in a signed record that members of the polling station and referred to the Government, together with other official documentation, the day following the election, before the thirteen hours.
2. In the certification indicates the number of electors entitled to vote, the number of voters, the number of spoiled ballots, white and valid votes obtained by each candidate in each polling station.
3. President proclaims the results of the CASS.
4. Against the proclamation of election results can be appealed before the Courts.
