By ruling of the Constitutional Court dated 1/2/10, acting as rapporteur D. Maus, because, 2009-18 RE, canceled an order for explusió when the decision of the Supreme Court does not provide a response to requests circumstanciada examination of expert evidence or testificals, as these are likely have an influence in relation to the assessment of proportionality, in that it allows not know if the practice of expert evidence and testificals was denied because of its lack of chronological connection with the decision of expulsion, or how can interpret the wording "at all affect the core of the decision" because of an a priori principle, which would not allow a specific assessment of proportionality.
